When a Breakup Puts Wealth and Reputation at Risk

For most people, the end of a serious relationship is difficult enough on its own. When significant assets, business interests, children, professional reputations and questions about trust enter the picture, a breakup can quickly become far more complicated.

High-net-worth separations often involve concerns that extend well beyond who keeps the house. There may be privately held companies, investment portfolios, real estate, valuable personal property and complex financial arrangements to address. Questions can also arise about hidden assets, digital privacy, personal conduct and allegations that carry consequences outside family court.

We spoke separately with four professionals who regularly encounter different aspects of high-conflict relationship breakdowns to understand what can happen when relationships, wealth and reputation collide.

When Suspicion Leads to an Investigation

When there is no longer trust in a relationship, people often turn to a private investigator to find answers.

Michael Porter, Senior Private Investigator with Haywood Hunt & Associates Inc. in Toronto, says his clients typically call him to investigate after they notice strange behaviours they cannot explain. While it is true that, in some instances, the cause for concern relates to suspected infidelity, investigations may also involve determining where one party was located, who they were with, whether they have an undisclosed relationship, whether they were conducting business unrelated to the marriage or other matters related to a larger dispute.

The purpose of a professional investigator is to obtain factual information in a lawful manner. This distinction is even more important in times of great emotional distress, such as when parties are separated emotionally and there may be a temptation to act on one’s own instincts instead of relying on objective information.

"When emotions run high, people can make decisions that ultimately exacerbate their problems. A professional investigation should focus on gathering credible information through lawful means while preserving confidentiality and adhering to the applicable laws governing surveillance and evidence collection."

Depending on the nature of the inquiry, investigators may conduct surveillance, perform background checks, interview witnesses or collect other types of factual information legally.

For individuals with public profiles, large businesses or considerable professional responsibilities, discretion may be extremely important. The investigation itself may need to be kept confidential until the client has determined how they wish to use the information collected by the investigator.

When a Breakup Becomes a Criminal Matter

While a difficult breakup can be traumatic enough, it can occasionally cross the line into criminal law.

Akash Dhillon, a criminal defence lawyer at A. Dhillon Law in Brampton, states that disputes between former partners can quickly escalate into police involvement when allegations of criminal behaviour are made, including assault, threats, harassment or damage to property.

Once police become involved, the dynamics of the situation can change drastically.

"It is not uncommon for people to believe that a dispute between spouses or partners will remain a purely private family matter. However, once an accusation of criminal conduct has been made, police and the criminal justice system can become involved very quickly. Anything you say, write, text or do during this time can have significant implications."

Being charged with a crime can have consequences far beyond the specific charge. Bail conditions can severely limit the ability of the parties to communicate or may restrict one party from residing at the shared residence. These restrictions can complicate issues involving parenting arrangements, access to personal property and ongoing family law proceedings.

For executives, professionals and businesspeople accused of crimes, allegations of wrongdoing can also create reputational concerns. Even before a case is adjudicated, having a pending charge can negatively influence employment prospects, public relations, business dealings and other aspects of a person’s professional life.

Therefore, the best way to manage a developing crisis is to avoid hasty reactions or confrontations and seek proper legal counsel before acting in ways that may worsen the situation.

Sorting Out the Financial Aspects of Your Separation

Sorting out the financial aspects of a separation can be overwhelming when significant amounts of money or property are at stake.

Malerie Rose, a family lawyer at Rose Family Law in Mississauga, notes that separating couples may need to deal with everything from the family home and investment accounts to pensions, corporations and other valuable properties and assets.

Complicating factors can arise when one partner has control over a company, has assets registered under a corporation or has multiple sources of revenue.

"In a high-net-worth separation, it is essential to fully understand all facets of the couple’s finances. It is crucial that the parties receive full disclosure of all assets, liabilities and income before any important decisions are made. Good financial disclosure can help eliminate speculative assumptions from influencing key decisions."

Asset values will need to be determined throughout the process. Businesses will often require independent valuations. Real estate properties may require appraisals. Investments, shareholder interests and certain forms of compensation may also require additional review.

Couples with significant assets may disagree on the value of assets brought into the marriage, property acquired through inheritance or money transferred between personal and corporate bank accounts.

Organizing your financial affairs early in your separation can provide tremendous benefits. Financial statements, tax returns, corporate documentation, property titles and investment account statements can enable lawyers and financial experts to gain a comprehensive view of your overall financial situation.

Protecting Your Children and Preserving Perspective

Divorces involving large sums of money can consume conversations. However, family law conflicts involving children are often the most challenging.

Manjeet Kaur, a family lawyer at Kaur Family Law in Brampton, suggests that parents experiencing conflict due to separation should consider that parenting decisions will have lasting effects beyond the resolution of financial matters.

"Separations are often characterized by substantial financial considerations. Nonetheless, parents dealing with conflict associated with separation must consider how their children are being affected. Maintaining continuity in children’s lives as much as possible and keeping children removed from adult disputes can significantly affect them during a very stressful transition."

Parents experiencing conflict during a separation can put their children in difficult positions. Children may be exposed to criticism directed toward the other parent, forced to serve as messengers between households or encouraged to take sides.

Family lawyers can assist parents in focusing discussions on creating routines for parenting time, scheduling, decision-making responsibility and other practical arrangements that allow children to maintain stability in their daily lives.

This is especially important for families where demanding careers, travel commitments, multiple residences or other logistical complexities already exist.

Discretion Can Be Equally Important as Assets

High-stakes breakups almost always involve more than one issue. Parenting concerns, financial disputes and suspicions leading to investigations can occur simultaneously. Confrontations resulting in police involvement, private matters being used as evidence in litigation and reputational issues arising from criminal allegations are all potential outcomes.
